Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DVIPlus platform (the “Service”) provided by My Auto Care, LLC, a South Carolina limited liability company doing business as DVIPlus (“Company,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
DVIPlus is a business-to-business SaaS platform that helps auto repair shops (“Shop” or “you”) send digital vehicle inspection videos to their customers (“Vehicle Owners”). A typical workflow:
- A technician records a video inspection of a Vehicle Owner’s vehicle.
- The Shop’s service adviser reviews and approves the video.
- An SMS is sent to the Vehicle Owner with a unique link to view the video.
- The Vehicle Owner can watch the video and chat with an AI-powered agent about the findings.
User Roles. A Shop account may include shop owners, hub admins, store managers, service advisers, and technicians. Each individual must have unique login credentials and is responsible for all activity under their account.
End Customers Are Not Direct Users. Vehicle Owners receiving SMS messages or viewing videos are not parties to these Terms. Shops are solely responsible for their interactions with Vehicle Owners, including obtaining all necessary consents.
2. Accounts and Eligibility
You must be at least 18 years old and authorized to bind the Shop to these Terms. You agree to provide accurate, complete registration information and to keep it current. You are responsible for safeguarding your account credentials.
3. Subscription and Billing
We offer monthly and annual subscription plans billed per shop location. All payments are processed by Stripe. Fees are billed in advance on a recurring basis and are non-refundable except as required by law. We may modify fees with at least 30 days’ notice; your continued use after a fee change constitutes acceptance.
4. Free Trial
New Shops may send up to three (3) video share-links at no charge, without providing payment information. After the third share-link, a paid plan is required to continue using the Service. We may modify or end the free trial at any time.
5. Acceptable Use
You may use the Service solely for its intended purpose: sending vehicle inspection videos and related transactional communications. You agree not to:
- Use the Service for marketing, spam, harassment, or any unlawful activity.
- Upload or transmit content that is abusive, obscene, defamatory, or unrelated to vehicle inspections.
- Interfere with the security or operation of the Service.
- Resell, sublicense, or time-share the Service without our written permission.
6. User Content and Data Ownership
As between you and us, you retain all rights to the data and content you provide through the Service, including inspection videos, repair order details, and Vehicle Owner information (“Shop Data”). You grant us a limited, non-exclusive license to use Shop Data solely to provide the Service and as described in our Privacy Policy. We process Shop Data on your behalf; we do not own it.
7. AI Agent Disclaimer
The AI-powered chat agent provides general educational information about auto repairs based on the inspection findings. It does not provide professional mechanical advice, diagnostics, or repair recommendations. Any repair decisions should be made in consultation with a qualified mechanic. We are not liable for any actions taken or not taken based on the AI agent’s responses.
8. Third-Party Services
The Service integrates with third-party providers, including Stripe (payments), Twilio (SMS), Cloudflare (video hosting), and an AI provider (chat). We are not responsible for the availability or practices of these services, and your use of them may be subject to their terms.
9. Intellectual Property
We own all rights, title, and interest in the DVIPlus platform, including its software, branding, and documentation. These Terms do not grant you any ownership interest. You may not copy, modify, or reverse-engineer any part of the Service.
10. DMCA / Copyright Notice
We respect intellectual property rights. If you believe that any user-generated video content on the Service infringes your copyright, please send a notice to our Designated Agent:

11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MY AUTO CARE, LLC OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless My Auto Care, LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your breach of these Terms, or your violation of applicable law or third-party rights.
14. Termination
Either party may terminate this agreement at any time by providing notice. We may suspend or terminate your access immediately for any breach of these Terms. Upon termination, your right to use the Service ceases. At your request, we can help you export your data before deletion.
15. Data Retention After Termination
After cancellation or termination, your Shop Data is soft-deleted (removed from active access) and retained for ninety (90) days. During that window, you may contact us to reactivate the account or export data. After 90 days, Shop Data is permanently deleted from our systems.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Charleston, South Carolina.
17. Changes to These Terms
We may modify these Terms from time to time. For material changes, we will provide at least 30 days’ notice via email to the account administrator and/or an in-app notification. Your continued use after the effective date constitutes acceptance.
